A friend (I will call him Ed) and fellow Hawaiian FGT owner has gotten himself into serious trouble. He was driving his GT when someone twice attempted to run him off of the road. Concerned for his safety and for that of his passenger, Ed pulled a handgun from somewhere in the car and pointed it out the driver’s side window. That had the intended effect of getting the people in the other car to back off. My friend then went to the nearest Police Station to report the incident and to file a complaint. As he was doing so, an occupant of the other car placed a 911 call to report that someone had pointed a gun at them.

The police asked Ed’s permission and searched his car. They found the gun, arrested Ed and confiscated his car. Ed had no idea that, under Hawaii Law, having a loaded handgun in a motor vehicle is a felony AND that using a vehicle in commission of a felony subjects the vehicle to confiscation.

Ed’s trial is scheduled for next month. He may go to jail and most “experts” think he will not get his car back.

I am relating this story in case any forum members carry a firearm in their car. Laws vary from state to state. If you carry a gun, please be aware of the possible consequences.
 
Seems like you have good laws in Hawaii.
I was trained that the last thing someone sees when you point a gun at them is a flash.

Ouch. That really, really sucks. I love how you can aim a 6000 lb hunk of steel at someone and not go to jail.
 
Sad story. My general rule is to never brandish a gun unless you intend to use it, because the situation is so grave that a reasonable person would believe his/her (family's) life is in mortal risk. This assume that you are expect and are willing to be judged by 6 rather than carried by 6.

Brandishing a gun for the purposes of intimidation is not recommend!

This is only MHO and in not legal advise. I am in CA, the laws in your state may vary and hopefully do.

In general, it might be considered acceptable if one was afraid for their life. They were afraid that persons in other car were going to intentionally run them off the road to kill them. His reporting this crime to the police would hopefully be evidence of that.

If you want to carry, get a permit. My local police chief and sherif issue them to responsible citizens. Seems reasonable to me.

In my town, or county a person will almost never get a permit, unless you are Diana Fenstein, or similar. I guess I could donate enough money to build a new police headquarters may me proper consideration. In CA it is all up to the policies of the LLE not the state.
 
Michigan laws are strict, but there is no favoritism.
1.You must get a permit from your local police to buy the gun . They do a search on you, but actually encouraged it...
2. take the pistol back to them for a safety inspection / registration before you use it.
3. and then take an 8-hour course (I took it with the actual local police in their office training room and on their range at the station.)
4. pay $100+ dollars at the county Court house.
5.Get fingerprinted , photographed.
6. 6 weeks later you have a photo ID mailed to you with all the details, your photo etc and you now have a 'permit to CCW' (Carry a Concealed Weapon)

((One of the major lessons they did teach is to never 'brandish'))

The NRA also has a very good booklet regarding the 'Reciprocity of States" that allow you to 'carry' if you have the permit in another state..

Bony...I am not sure you can purchase a 'Brown Note" cannon....however, if I were planning to attend and protest at the Democratic Convention in Denver, I would bring some extra 'Depends'. Too bad, since Denver is truly a sweet smelling city .

There is a saying here in the UK (where handguns are banned), 'ignorance of the law is no defence' which would apply in this case.

I'm sorry that he might be deprived of his liberty and GT, but pulling a loaded gun on someone (who was unarmed) is, at best, foolish.

Where would one keep a loaded gun in a GT by the way? Is there a new carbon fibre part now available?

First phrase said when officer shows up to collect the body. "I was in fear of my life." Second when asked how many shots did you shoot? "I don't know maybe one or two" (when in fact you likely dropped the whole clip ... or should have).

RE "ED". If he definitely feared for his life and was making a police report. He has a good chance of getting off with the help of the NRA and an attorney. His comment on the stand would likely be ... I was afraid for my life but at the last moment could not bring myself to pull the trigger. (rational fight/flight response).

I don't advocate pulling a gun for any reason other to use it. Either to train or defend those are the only two reasons that a gun should come out other than for maint. With that said, if we ani't going to the range, we're not talking about guns and I pull a firearm .. .. get ready to meet St. Peter. :lol

But on a more serious note. We all have nice cars and people get pushy from time to time just trying to get a look. I have developed the tactic that use a bit of wisdom. Stop for gas and just let them look at the car. If you're stopped for gas there are usually cameras recording the event, witnesses and etc. In the rare case that someone has "evil intent" then you are covered when it comes to the draw and fire sequence. (read that again .. draw and fire sequence) If the brain sez "yous in danger" .. pull, fire and keep plugging until the gun makes no more noise. If you have other threats change mags and get ready for round two. Most CC owners don't spend enough time at the range so learn to "spray and pray" unless you want to spend the hours and hours that it takes to learn to be "tactically sound" when your heart is racing at 130-170 bpm. If you shoot less than 2000 rounds out of your carry weapon a year that it takes to be a shooter ... practice the art of supression fire. also learn to shoot your pistol at 15 yards or greater from your target ... if you can hit that in the kill zone then at 10 feet you can also when your heart is in the abovementioned range.

First of all, having an UNLOADED piece in one's car, home, or on one's person isn't much good for ANYTHING. Least of all for defending one's self.

That said: laws which declare, in effect, that only CRIMINALS can carry whenever/wherever (in a car for instance) ARE RIDICULOUS! I give you the "gun free zones" as a prime example (can you say, "Virgina Tech"?). 'Absolutely STOOOOOPID policy!!! STUPID, STUPID, STUPID!

I CANNOT imagine any state being so IDIOTIC as to disallow someone who has a "carry permit" to have said weapon on his person IN HIS CAR! I mean - come on!!!!! That's just totally brainless!

I'm a bit confused about "Ed". Are you saying he DIDN'T/DOESN'T have a carry permit??? Is THAT the overriding issue here aside from brandishing it?
 
First off "Gun control" for me means being able to put 95% of a 45ACP clip on target between 10 and 25 yards. Brandishing a firearm at shows intent, if the intent was only to say "back off" (based on information given). My right hand would not have reached for the gun but the gear shift and my right foot would have found the floor.
