This is most likely not the place to post this, but since most read this forum first i will try...

I am having a car built for racing. Car is suppose to be done. Bulider has indicated that he will not take my credit card or check as payment. I offered to pay cash. He has declined. I imagine he wants a certified check.

Now he has had my $$$ for 1 year. This build was to take 8 - 10 weeks. There is a lot of bad feelings & lack of trust. I would like to take a look at the car before i hand over the funds. He says not. Balance must be paid in advance before picking up car.

Can anyone refer an attorney or take a trip to this guys shop to see if it is infact finished?

Frank,

Has he sent you pictures yet? Tell him to fill up 24 exposures from a disposable camera and mail it to you. Couldn't hurt to have a picture of the front of the local newspaper for date reasons either.

Only Picture is of the Body, Painted...If the car is done i'd like to take a look at it to make sure everything that is to be there is there. If i send him a Certified check, how do i know i will get the car? This is why i suggested i pay cash after i look the car over.

Get a certified senior appraiser to review the work and report to you what has been accomplished abd what the calibre of the work is.

Check with our Ohio members for a recommendation.

I will be moving this thread to the pit later tonight.

Use common sense. If he will not let you inspect the car before you pay, SOMETHING IS WRONG. It is not an unreasonable request to ask to see what you are paying for. Call an atty, call the police. DONT SEND MONEY.

I hope all works out for you. I can not stand people that conduct business this way. Its just not the american way. The customer should be treated with respect at all cause. I would just show up at the place with money in hand and say, "I am here, show me my car and I will pay you your money"

Call the police. He has your money and won't give you your product.
Don't be Scammed.

Unfortunately if i call the police they will not be able to do anything since in their eyes it will be a civil matter. Hoping in my truck with trailer in tow sounds great but i'm 6 hours away & i do not know what this persons schedule is like. I do need an attorney, i even asked him to find an escrow service to hold $$$ until i go over the car. NO DICE....

I have contacted the Bar Association of Columbus Ohio, but they can only give me names & numbers. I would like a referral.

Seems like hiring an attorney is wasting money...
Get a pro senior ASA appraiser who specializes in automobiles to go in and take a look, these folks are neutral and will only report what they have actually seen.
If your SAAC member they have a list of automotive lawyers.
What kind of car is it, tell us more.

Bony you have PM.....I have contacted the Ohio Attorney Generals office, filed a complaint, also filed a complaint with the BBB.....

The type of car is called Pro Challange. If is a 3/4 scale Bush size car. I wanted to purchase for the ease of doing my own work on the car. Some cars you need a pit crew, with this i felt that you did not.
ZX Kawasaki 1400 motor, weight 1600 lbs, sequential trans. I rented 1 2'xs last year had a good time.

Again Frank, ask the shop if they will allow a neutral third party to come inspect the work as outlined on the work order. Get a ASA Senior Automotive Appraiser to be that party.
It will be a hell of lot cheaper, quicker than any lawyer.

Typical lawyer, unless he is a real car guy will not have a clue of what the work order states and if the calibre of work is up to industry standards.

Sound like a fun project, sorry the project has turned south on you.

I agree with BONY, hiring an attorney will keep this in court for ever.....You live 6 hours away? is that all? Please, get into your truck, take a friend with you ( a big one) and go there. How he can possibly not show you the car before you pay him is something I have never heard of in my life. I think when you show up with money in hand, he will have no choice not to show you the car.

What ever you do, I hope you can look back at this and laugh about it...not worth the aggravation from some SOB's of this world. Good Luck.

P.S. If he wont show you the car, about going to a local Police Station and have a Cop escort you there? If you can prove it;s your car, I imagine the PD can get you to see it before paying for it. What he did, or not do is another matter.

My 2 1/2 cents worth..

well, showing up with 'da boys' would not be my approach...

try to use sugar first, if at all possible. I ass-U-me you the shop owner have already crossed swords.

reach out for Tim Cantwell, we had a guy on the Forum a couple of years ago that had an amazing stable of exotics. They have to know somebody that can act as an ombudsman.

on another subject,... note to self, be nice to Gino... jayzus christo :)

I say, start a riot. Make sure lots of people show up to break stuff. Call me when your done www.deltabail.com

Can a bondsman in TX provide services to someone in CA?

Man you tell the guy you want to see the car period! You fly up and inspect it and if it is what its supposed to be you get the cert check pick up your car and split, and if not you have no choice but sue! I would never send a penny without seeing the car because if you already have had a problem you are guaranteed to have more! Definately don't throw any more good money after bad!

Well said!

Pit Crew.

This is one of those times when well a seasoned bunch of good old boys could straighten this matter right out. Show up with your "pit crew" talk racing or start fighting, settle it the NASCAR way.:thumbsup
