It was an alternate reality they stumbled into and now they regret it and want to come back:
Jack's father is still alive
Kate is not arrested because she never commited murders in that alternate reality.
Kate is with another man other than Sawyer or Jack (the man she never met until she went and saw her other life in the alternate reality)
Sawyer is dead. He is Jack Betham (the name in the newspaper) he took on another alias when they arrived. This is easily revealed when Jack tells kate" I thought I would at least see you there!" at the funeral.
The girl that Locke killed said she knew they were dead in the air liner crash and the bodies had been found (again the time rift opned up for her rrelaity,.....etc... the wrong one they went back to).
Other thoughts:
Too much screwing around with alternate dimensions can rip the fabric of space and that is why Ben is freaking out.
Jacob is actually Locke , another time twist that will be revealed eventually.
